Judges deny appeal in Wind Gone case

ATLANTA, Georgia, October 14, 2001 -- An earlier decision supporting Houghton Mifflin in publishing a parody of Margaret Mitchell's Civil War classic Gone With the Wind was upheld by a federal appeals court. Mitchell's estate had wanted to stop the parody, The Wind Done Gone by Alice Randall, arguing that the book infringed on its copyright. The Mitchell estate won in the first court that heard the case, but the appellate court rejected that decision. In turning down the Mitchell estate's latest appeal, one appellate judge said the estate "has fallen well short of establishing a likelihood of success on its copyright infringement claim."
